The Seventh Court of Appeals in Amarillo granted Mark Meurer’s request to dismiss his appeal against Jason Corley on Sept. 30 and ordered Meurer to pay the court costs.

The civil appeal arose from the dispute over Lubbock County’s Precinct 2 commissioner seat. The court said Meurer’s agreed motion requested voluntary dismissal and also assessed court costs against him. The court ruling did not address the merits of the appeal itself.

Meurer announced in a written statment on September 16th that he would withdrawell his appeal and return the full amount of salary payments he received.

The court directed its mandate to be issued immediately and said it would entertain no motion for rehearing. The order was filed October 1st in Lubbock County’s 237th District Court.

This dismissal is separate from any pending criminal investigation into nearly $70,000 in county salary payments to Meurer while Corley occupied the commissioner’s seat. Lubbock Lights has no information regarding any specific person under criminal investigation related to these payments.

Lubbock County Criminal District Attorney Sunshine Stanek recused her office from the investigation and later referred it to the Midland County District Attorney’s Office.

The 7th Court’s ruling as to cost does not address whether Lubbock County paid any of Meurer’s attorney’s fees.
